RETURNS & WARRANTY

Returns

Our returns policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your return, we require a receipt or proof of purchase.
There are certain situations where only partial refunds are granted (if applicable)

1. Any item not in its original condition, is damaged or missing parts for reasons not due to our error
2. Any item that is returned more than 30 days after delivery

Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at sales@minleon.com.au.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at sales@minleon.com.au and send your item to: 23 Wolfgang Road, Albion Park New South Wales, AU 2527.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over $100, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Warranty and additional terms

1. General

The following General Terms and Conditions of Sale and Supply form part of the contract between Minleon Australia and New Zealand and the contracting and/or purchasing party. Amendments to these General Terms and Conditions of Sale and Supply may only be made in writing by Minleon Australia and New Zealand.

2. Offers / Conclusion of contract

Offers made by Minleon Australia and New Zealand are without obligation in respect of prices, quantities and delivery dates.. The contract exists to the extent that Minleon Australia and New Zealand confirmed in writing its acceptance of the order or accepts the order through the delivery of the goods.

3. Prices and terms of payment

Payments are not considered to have been made until cleared funds are available in Minleon Australia and New Zealand bank account.

4. Deliveries

Deliveries are from Wollongong NSW Australia or are direct from Guangdong Province China depending on order quantity, type and customers’ requirements. If direct from China then the cost would be determined based on the shipping method chosen. Local shipping is not included in the final price.
Unless definite fixed delivery dates or a definite period of delivery are expressly agreed in writing in individual cases, the dates or periods of delivery quoted shall be regarded as guidelines which Minleon Australia and New Zealand will endeavor to comply with.
Exceeding these dates or periods shall not constitute any default on the part of Minleon Australia and New Zealand.
Alternatively, in the event that delivery dates / delivery periods are expressly agreed, the delivery period shall commence upon dispatch of the order confirmation, however not before the documents, permits and approvals to be furnished by the contracting party are to hand and an initial 50% deposit has been received. The remaining 50% is to be received before final shipping.
The delivery period shall be regarded as complied with provided that, prior to its expiry, the contracting party shall have been notified that the delivery item is ready for dispatch.
The delivery period shall be appropriately extended in cases of force majeure such as e.g. industrial disputes, in particular strikes and lockouts, fire, flood, want of energy, raw materials or process materials, official injunctions or other impediments for which Minleon Australia and New Zealand is not responsible.
This shall likewise apply in the event that such circumstances afflict subcontractors to Minleon Australia and New Zealand.
Should Minleon Australia and New Zealand be in default in the performance of the service it has committed to deliver, the contractual partner’s claim for compensation shall be governed, mutatis mutandi, by section 8 of these terms and conditions.
In the event that dispatch is delayed at the request of the contracting party, following notification that the goods are ready for dispatch the costs incurred in storage will be billed to the contracting party; in the case of storage at Minleon Australia and New Zealand or Minleon China works there will be a charge of five (5) percent of the invoice value for each month of storage unless otherwise agreed in writing by Minleon Australia and New Zealand. Over seven (7) days of delay to dispatch will be considered as one (1) month.
Minleon Australia and New Zealand reserves the right, should the manufacturer or supplier change the design and shape or change the scope of the delivery or vary the colour tone up to the time of delivery, to change the order provided however that such changes and variances are reasonable from the point of view of the customer, due regard having been paid to Minleon Australia and New Zealand interests.

5. Notice of defects

Should the contractual partner discover a defect in the goods supplied then the claim in respect of defective goods shall be reported to Minleon Australia and New Zealand in writing immediately after the delivery has been received by the contractual partner and in the case of obvious defects at the latest within seven (7) working days, together with necessary documents.
In the case of concealed defects, written notice must be given immediately upon detection, however no later than the specified warranty period following receipt of delivery by the contracting party.
The onus shall be upon the contracting party to prove the existence of a concealed defect. Should defects not be notified in accordance with the above requirements, no claims may be made under the terms of the guarantee.
Goods, which are the subject of complaint, may be returned to Minleon Australia and New Zealand only when express approval is given in writing by Minleon Australia and New Zealand.

6. Warranty

Minleon Australia & New Zealand Pty Ltd warrants their products to be free of defects in materials and workmanship for a period as specified from the date of purchase.

Minleons WARRANTY does not apply to defects resulting from any action of the purchaser, including but not limited to mishandling, improper interfacing, operation outside of design limits, improper repair, or unauthorized modification. This WARRANTY is VOID if any products shows evidence of having been tampered with or shows evidence of being damaged as a result of improper installation or excessive re-installation, excessive corrosion, or current, heat, moisture or vibration; improper specification; misapplication; misuse, lightning strikes, floods or other operating conditions outside of Minleons control.

MINLEON MAKES NO OTHER WARRANTIES OR REPRESENTATIONS OF ANY KIND WHATSOEVER, EXPRESSED OR IMPLIED, EXCEPT THAT OF TITLE, AND ALL IMPLIED WARRANTIES INCLUDING ANY WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED

In the event of defects Minleon Australia and New Zealand will at its discretion either carry out rectification or supply a replacement for a period of the specified warranty period from the date of receiving the items.

Claims by the contracting party to compensation for expenses incurred in conjunction with the subsequent performance, in particular transport, travel, labour and material costs are excluded where such expenditure is increased because the defective delivery item has been transferred to a location other the contracting party’s premises which does not accord with its evident purpose.

Guarantee claims are likewise excluded if defects are attributable to the contracting party in consequence of a breach of operating, maintenance or installation instructions, unsuitable or improper use, incorrect or negligent treatment, overuse, natural wear and tear, or incorrect repair.
Provided that the defects were not maliciously concealed, the claim for warranty expires when the specified warranty period from the date of purchase to the contractual partner

7. Extent of warranty

All return warranty shipping costs are the responsibility of the purchaser where Minleon Australia will pay for all shipping costs for warranty replacements back to the purchaser

A defective product must be returned for inspection before a replacement can be sent unless prior arrangements have been made with Minleon Australia & New Zealand

If an item cannot be replaced with a like for like then either a similar replacement or a store credit will given to the value of the warranty replacement

8. Liability

Minleon Australia and New Zealand shall not be liable for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

9. Nature and quality

The nature and quality of the goods supplied shall be exclusively as specified in the product descriptions and specifications issued by Minleon Australia and New Zealand warranty and not in accordance with any public statements, any type of praising or advertising statements. Public statements, recommendations, and advertisements shall not be applicable.
Advice both verbal and written is given by Minleon Australia and New Zealand warranty to the best of its knowledge and belief. Such advice must however be regarded as noncommittal and in no way exempts the contracting party from the need to independently verify that the goods supplied are suitable for the intended processes and purposes..

10. Applicable law & Jurisdiction

These General Terms and Conditions of Sale and Supply will be subject to the laws of Australia and New Zealand and the Australian courts will have jurisdiction in respect of any dispute arising from the contract.

In any event of a dispute over jurisdiction and Applicable laws then the laws of New South Wales, Australia will apply.

11. Severability

Should any individual provisions among these General Terms and Conditions of Sale and Supply be or become invalid, the validity of the remaining provisions hereof shall in no way be affected.
